1. General Terms
1.1. The website www.idealeyes.gr is the electronic store that displays and sells products over the internet, which will be hereinafter, for sake of brevity, referred to as “e-shop”, created and operated by the company under the name “S. MAGRIZOS & CO” and trade name “Magrizos Optical” (hereinafter, for sake of brevity, will be also called as “company” or “Magrizos Optical”), headquartered in the store located at 2, Asklipiou Str., Larissa, Greece (VAT Registration No.: 082292916, Tax Office: Α΄ Larissa, REGISTRATION NUMBER: 026448440000).
Before you enter the e-shop and browse to our website, we invite you to carefully study, understand and agree with the following terms and conditions, which specifically apply to the use of the e-shop and govern the transactions carried out through it. It is noted that, browsing, using and carrying out transactions through the e-shop, entails an explicit and unconditional consent and your agreement to, unexceptionally, all of the following terms and specific conditions. If a user does not agree should abstain from the use of the e-shop, as well as from carrying out any transaction through it.
1.2. The company reserves the right to modify unilaterally and/or update the present terms and conditions of the transactions carried out through the e-shop in order to agree and comply with the needs of the company and the applicable transactional morals and/or the legal framework. Furthermore, it reserves the right for the same above mentioned reasons to add new trading conditions. These changes, updates and additions will be made known to the consumer public through the e-shop’s website.
1.3. The present terms and conditions, as well as all contracts concluded via the e-shop are governed by Greek Law. For any disputes that may arise, the competent Courts of Larissa are designated.
2. Provided information and products
The company makes every effort to provide complete, authoritative and accurate information on the e-shop, regarding the exact details of the products displayed and sold through their e-shop, subject to any technical or typographical errors that can not be predicted or occur unintentionally.
3. Limitation of Liability
3.1. The presentation of the products for sale in the e-shop carries the character of invitation to the users/consumers to submit contract drafting proposal. As for the presentation, does not constitute in any way a commitment of the company for the availability and adequacy of the displayed products and services (Articles 127 et seq. CC). The company guarantees the prompt information to the final consumers about their unavailability.
3.2. The company is not liable to the customers/users for damages that may result after carrying out or not of their order (except for the cases in paragraph 9. "Withdrawal/Return - Replacement of Products").
3.3. The company reserves the right for the non-compliance of the planned by the present terms of products delivery time, in cases pertaining to incidents of force majeure, as well as in circumstances pertaining to the influence realm of third natural or legal persons necessarily involved in the process of shipment and delivery of goods.
3.4. The e-shop provides the content (e.g. information, names, photographs, illustrations, etc.), products and services available through the website "exactly as is". In any case, the e-shop is not responsible (civil, criminal, etc.) for any claims arising from visitors and/or users of the e-shop and/or any damage (positive, consequential, which, indicatively and without limitation, alternatively and / or cumulatively constitutes a loss of profits, data, foregone earnings) incurred by visitors of the website or third parties on cause related to the operation or not and/or the use of the website and/or inability to provide services and/or information available on the website and/or any unauthorized third party interventions to products and/or services and/or information available through it.
3.5. The website www.idealeyes.gr can in many cases refer through "links", hyperlinks or advertising banners to other websites, providers of which have full responsibility (civil, criminal, etc.) for the security, legality and reliability of their website content and services, excluding any liability of the company, such as indicative liability on copyrights and industrial property rights or any third party right. Therefore, users are obliged to comply with the terms of use of these websites and appeal directly to their providers for anything resulting from the visit and/or use of them.
4. Copyrights and Industrial Property Rights
4.1. This website is the official e-shop of the company. The entire content of the website, defined as the entire set of images, graphics, photographs, designs, texts, provided services and products, is lawfully owned by the company and protected by the relevant provisions of Greek law, European law and international conventions for the protection Copyright. Any act in the above legal framework and the relevant case law is prohibited and considered as a violation of the holder’s Copyrights. Therefore, inter alia, copying, analog/digital recording and mechanical reproduction, distribution, transmission, downloading, transformation, resale, creation of derivative work, or misleading the public about the real provider and owner of the Content of the website are prohibited. Any reproduction, republication, uploading, announcement, dissemination or transmission, or any other use of the Content in any way or means for commercial or other purposes is permitted only with prior written permission of the company.
4.2. The names, images, any graphic applications, logos, as the well as the domain name used generally in transactions and in the e-shop, in order to represent the company and/or its e-shop (www.idealeyes.gr) and/or third parties contracted with them, as well as their products or services, constitute trade marks and distinctive marks of the business and/or www.idealeyes.gr and/or the above mentioned third parties and are protected by the Greek, European and International trademark, copyright and industrial property laws. In any case, their appearance and exposure on the website www.idealeyes.gr and the e-shop of the company should not by no means be considered as transfer or license assignment or provision of the right to use.
5. User Obligations
5.1. Users of www.idealeyes.gr website agree not to use the e-shop of the company for sending, publication, e-mail or transmission in other ways of any content that is unlawful, harmful, threatening, abusive, harassing, disparaging, defamatory, vulgar, obscene, libelous, violates the privacy of someone else, shows empathy, or expresses racial, ethnic or other discrimination, may cause harm to minors in any way, has not right to be transmitted according to legislation or violates any copyright or industrial property (indicative patent, trademark, trade secret, know-how, copyright or other proprietary rights of third parties), contains software viruses or any other codes, files or programs designed to interrupt, damage, destruction or equipping the operation of any computer software or hardware, intentionally or unintentionally violates the applicable Greek and EU legislation and its provisions that may molest third parties in any way and any content used to collect or store personal data regarding other users.
5.2. In case of illegal or contrary to the present terms of use of the e-shop users are obliged to compensate the company for any loss of damage. The non-exercise by the company of the present terms of its rights does not imply a resignation of those rights.
6. Security
The company recognizes the importance of personal data security issue, as well as online transactions and takes all necessary measures, with the most contemporary and advanced methods, in order to ensure maximum security to visitors-users of the e-shop. All information related to personal data and to transactions of visitors-users, are secure and confidential. Security of the company's e-shop is achieved through the following methods: customer's identification, the codes used for identification are two: the entry code (e-mail or username) and Personal Secret Security Code (password), which every time are entered provide the users with completely secure access to their personal data. Personal Secret Security Code (password) can be changed by users at any time. Users are the only ones who have access to their data, through the above codes and therefore are solely responsible for maintaining the secrecy and concealment from third parties. In case of its loss or leakage, the user should immediately notify the company, otherwise the latter disclaims any responsibility for the use of a password by an unauthorized person to do so. It is recommended, for security reasons, the change of the password on a regular basis and the customization of the codes in such a way not to become easily traceable.
7. Communications Confidentiality and Personal Data Protection
7.1. All information provided is confidential and the company has taken all necessary measures in order to use them only to the extent considered necessary in the context of offered services. Some of the measures taken are the following: a) Only authorized employees have access to information of your transactions and only when it concerns the processing of your applications. b) The company does not disclose to third parties or process customers' data and transactions, unless it has written authorization from them or this is imposed by court order or decision of other public authority with enforceable character. c) In case of in the context of the company's electronic systems support third parties are used, the company takes care to ensure confidentiality. Users may have access to such information as well as to request correction in case substantiated error.
7.2. The e-shop operates according to the applicable Greek and EU legislation and securely maintains your personal data for as long as you are registered with a service of www.idealeyes.gr, which are deleted after expiration, in any way, of the trading relationship. The personal data declared in the e-shop are used exclusively by this or businesses affiliated with it, but in this case, with the sole purpose to support, promote and execute the trading relationship. The maintained data file may be communicated to the competent judicial, police and other administrative authorities upon legal request and in accordance with the current legislative provisions. The customer retains the disclosure and refusal rights predicted by the Articles 11-13 of Law 2472/1997.
7.3. Users when visiting the e-shop in order to make the order of products, but also to ensure the possibility of communication with them, it is likely to provide information concerning: name, occupation, electronic address, date of birth, etc. Any personal data declared anywhere on the pages and services of the website of www.idealeyes.gr, are intended exclusively to ensure the operation of the corresponding service and the successful completion of the transaction and are not used by any third party, without complying with the provisions of Law. 2472/97 concerning the protection of processing of personal data, as applicable every time.
7.4. Users may request to receive informational catalogs and printed material upon registration as members of the e-shop, maintaining at any time the right to opt out of this service.
7.5. The company, subject to the above, does not disclose or publish to third parties the personal data of users-members of the e-shop. All information is encrypted and stored in absolute safety.
8. Purchase Contract
8.1. The purchase contract between the company and the user will be considered qualified and valid from the time the customer, after making a final review of the products to be purchased, including the final price plus VAT, submits the order form, always provided that the credit card of the user has been approved, or the deposit of the amount in the business’ bank account has been completed, or the payment via Paypal service has been approved.
8.2. The company will send an e-mail to the user's e-mail address (in case there is no e-mail address, there will be a telephone communication), which will include a summary of the order, as well as the electronic address (e-mail) to which the customer can contact the company for any complaints, the commercial guarantees, the cost of the order (the value of products and their shipment value), the timeframe within which the customer can exercise the right of withdrawal. The user should immediately confirm the content of the e-mail and inform the company in case of error.
8.3. The user may cancel the order before it is completed and during the electronic order process by selecting the "Cancel" button which is located under the central of the screen. By this selection the ordering process stops automatically. The customer may cancel the order even if the online order is completed but before the products are dispatched, by calling the call center of the e-shop at 0030-2410-531123 during store opening hours (see term 16 of the present) and one of our associates will take care of the order's cancellation.
9. Unjustified Withdrawal
The user has the right of unjustified withdrawal of the contract within a time limit of 5 calendar days after delivery and even when they are many products on the same order from delivery of the last one. The withdrawal is done under the following conditions:
a. This withdrawal is unjustified and if the item has already been delivered the customer should return the product exactly in the condition it was received, with the entire set of its accessories, the printed materials that accompany it (e.g. original receipt of purchase, the authentication form) and its packaging in perfect condition. The return of the product is accepted only if the buyer has paid any amount that may burdened the company to ship the product to him and the shipping costs for returning the item.
b. The withdrawal is declared in the above mentioned period of time, written or via e-mail or via telephone communication, and the company should confirm it.
c. The return of money to the customer will be made by the same means by which the original collection was made or by bank deposit that the customer will indicate, at the absolute discretion of the company.
d. The customer is liable to compensate the company if has made use other than that which is necessary to establish the nature, characteristics and function of the goods at a period up to the declaration of withdrawal.
10. Prices
All product prices displayed in e-shop are in Euro and include VAT and all relevant taxes. The products' prices of the e-shop are only applied to purchase through it and not to the purchase from our physical store. Delivery of products throughout Greece has no shipping cost, while for delivery abroad the shipping cost depends on the country of delivery.
11. Order Delay
Your order may be delayed for the following reasons:
The product has delayed to be sent from our supplier: To be able to offer you very competitive prices, we order our products from a very wide range of suppliers either domestic or international. But there are cases where an order of ours can "get stuck" to the customs office or in the transfer, with the result not to have it in store when we estimate. In such a case, we will contact you to ask you if you want us to deliver your order without this product or to suggest an alternative. This product will be sent to you immediately upon receipt in our warehouse. The product you ordered has been discontinued and is not available: Among the many products that we expose in our e-shop there are rare cases where their supplier suddenly and unexpectedly announces that they are discontinued. In this case a member of our staff will contact you immediately to give you all the alternatives. In times of extreme weather or strikes, as well as in any case of force majeure, likely to affect the transport and delivery of your order. In case the telephone and/or electronic (e-mail) communication with you is impossible (if a problem with your order occurs, either related to the product or the payment) because e.g. the information you entered is not properly updated.
12. Payment Methods
The payment methods in the e-shop are the following, at the choice of users:
a. With credit, debit and prepaid cards. Our shop cooperates with Piraeus Bank and your personal data is completely secured.
b. Via Paypal. A necessary prerequisite is to create an account through www.paypal.com website with the terms and conditions applicable there.
c. Cash on delivery (COD). If you do not want to use your credit card you can pay the distributor upon delivery of the package (applicable only in Greece).
d. With direct deposit to a bank account. Our shop cooperates with Piraeus Bank. The IBAN account number held by the company at Piraeus Bank is GR 3401726090005609010890741.
13. Shipment - Delivery
Delivery of products that are immediately available takes 1 - 3 working days to the maximum, depending on the area in Greece and 10 working days depending on the country of delivery. Delivery of products available upon request takes approximately 10 - 15 working days, depending on their availability at the Supplier Company.
Distribution of products is carried daily from Monday to Friday, 09.00 to 18.00. Deliveries may be delayed due to force majeure, as well as for reasons not related to the company's influence and depend on third parties, such as: due to strikes, or bad weather conditions, or if the desired location is isolated.
The company takes all necessary measures to ensure that all products are packed with very careful manner in order to receive them without damage.
It is useful that customers choose addresses where at all times and within the delivery hours above mentioned there is a person who can legitimately receive the products.
Delivery of products throughout Greece has no Shipping Cost, while for delivery abroad the Shipping Cost depends on the country of delivery.
14. Specific Conditions related to the sunglasses products sold through the e-shop
14.1. Use of sunglasses is not indicated in conditions of restricted visibility or at night. The sunglasses should not be used to view directly the sun or as protection from artificial light sources (e.g. lamps for artificial tanning). Sensitivity to light especially in conditions of intense brightness as on the snow or in the open sea differs from person to person and dark colored filters should be used to reduce solar radiation in the visual field. Sunglasses can not be used as as protection from collisions or knocks during which the glasses can break, causing injuries to the face and eyes.
14.2. Sunglasses must be stored inside their case at a temperature between -10⁰ and + 35⁰C. Avoid their exposure to the sun in closed environment and without air (e.g. the car dashboard) because it can cause irreparable damages.
14.3. In case of lenses damage (e.g. scratches, fogging) it is recommended to replace them with original spare parts.
14.4. For the cleaning of the lenses use running warm tap water. This will remove any dust or sand grains that can cause scratches. Rub a few drops of a common, neutral, liquid detergent and dry with a soft clean fabric. Avoid using solvents (e.g. alcohol or acetone) and chemical detergents that can compromise the functionality of the glasses.
14.5. Always place your sunglasses in a protective case when not wearing them. Carefully check the alignment of your sunglasses while standing in front of a mirror. If they do not look properly aligned, visit your optician for an adjustment to the frame.
15. Return-Replacement of Products - Distributor's Warranties
15.1. The customer may return the products purchased and ask for their replacement under the following conditions:
15.1.1. Within 14 days follow their receipt, in all cases where by a demonstrable fault of the company the wrong products were sold.
15.1.2. Within 12 months follow their receipt, in all cases ( fair use policy applies) where there was a real defect (in function or quality), without the customer's fault, which is covered by the guarantee of the Distributor and provided that the company will judge that it is not possible to repair the products with free work offered by the company and by purchasing parts that may be needed in special discounted rates charged to the customer and if the customer agrees in advance with it.
15.2. In all the above cases of return and replacement the customer should accompany the product for replacement-repair with the original purchase receipt, the certificate of authentication that accompanies all products sold by the company, which is obliged to carry the company's stamp, the product's characteristics and the date of sale to the customer and return to the company the product in the condition he received them, complete, undamaged, in perfect condition, with the packaging and all documents that normally accompany it.
Before any return a prior consultation with the company is recommended.
